  3. Section III. Legal, economic, financial and technical information

        In order to sign the contract with the selected most favorable economic operator, the successful bidder shall be required to provide a contract performance bank guarantee in the amount of 5 % of the contract value.

The contracting authority shall not require the group of bidders to be associated in an appropriate legal form if the group is selected as the carrier of the procurement.

      1. Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
        Information and formalities necessary for evaluating if the requirements are met:

        1) For proving personal status, economic operator should provide the following documents:

        — Statement by the economic operator that in the previous 5 years, an effective court decision for participation in criminal organisation, corruption, fraud or money laundering, has not been announced,

        — a Certificate that it is not subject to bankruptcy procedure issued by a competent authority,

        — a Certificate that it is not subject to liquidation procedure issued by a competent authority,

        — a Certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established,

        — a Certificate from the Register of penalties for criminal acts committed by legal entities that a secondary penalty ban on participation in procedures for public announcement, the award of public supply contracts and public-private partnership, has not been imposed,

        — a Certificate from the Register of penalties for criminal acts committed by legal entities that a secondary penalty temporary or permanent prohibition of certain activities has not been imposed and,

        — A Certificate that a sanction for misdemeanour with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. temporary prohibition for performing professional activity, it is not being announced.

        2. Document for registered activity — A document for a registered activity as a proof that the operator is registered as a natural person or a legal entity to perform an activity related to the public procurement contract or proof of membership in an appropriate professional association in accordance with the regulations of the country where the operator is registered,

        Economic operator shall prove the fulfillment of special requirements for performing activity prescribed in accordance with the law by submitting the following document:

        — Valid license for performing insurance activities in the respective classes of insurance (for Lot 1 — classes of insurance 7,8 and 9 and for Lot 2 — classes of insurance 3 and 10) that is subject to public procurement, according to the Law on Insurance Supervision ( ‘ Official Gazette of the Republic of Macedonia’ No. 27/02, 84/02 ........... 192/15 and 23/16) issued by a competent authority.

      2. Economic and financial ability
        Information and formalities necessary for evaluating if the requirements are met:

        Necessary documents for economic and financial ability of the economic operator:

        The economic operator shall prove the fulfillment of the minimum requirements by submitting one or more of the following documents:

        — Appropriate bank statements;

        — Report on the balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance sheet is required under the law of the country in which the economic operator is established, for the last financial year;

        — Statement of overall turnover (data from the income statement issued by a competent authority, i.e. audited income statement) and, where appropriate, of turnover in the area covered by the contract and for the last financial year that such information is available, depending on the date on which the undertaking was set up or started work and depending on the availability of such information.

        Minimum level(s) of standards possibly required:

        — Minimum annual turnover in the amount of 30 000 000 denars in the previous year ( in case the bid refers only to Lot 1 or to both Lots 1 and 2).

        — Minimum annual turnover in the amount of 5 000 000 denars in the previous year ( in case the bid refers only to Lot 2).

        — Positive financial report for the previous financial year.

      3. Technical capacity
        Information and formalities necessary for evaluating if the requirements are met:

        Necessary documents for technical or professional ability of the economic operator:

        — Evidence for reinsurance with reinsurance rates (by providing a copy of reinsurance contracts with the first reinsurer valid for 2017),

        — Reinsurance program for 2017,

        — Providing ‘Insurance Conditions’ (General and Specific) for the concrete procurement,

        — A list of provided property insurance services to legal entities in the last three years, with values, dates, buyers (contracting authorities and economic operators), and providing at least three (3) statements for the provided services issued by the recipients or providing a copy of at least three (3) contracts for insurance of property and movables of legal entities for the previous year, with an individual value of the contracts not less than 1 500 000 denars ( in case the bid refers only to Lot 1 or to both Lots 1 and 2), or providing a copy of at least three (3) contracts for insurance of motor vehicles for the previous year, with an individual value of the contracts not less than 250 000 denars ( in case the bid refers only to Lot 2),

        — Statement for the amount of the highest paid damages in the last 3 years,

        — A statement that the economic operator has engaged professional personnel qualified to assess the damages adequate to the concrete procurement,

        — Notification on the elements of the contract which the economic operator intends to subcontract to third parties (if necessary).

        Minimum level(s) of standards possibly required:

        — 100 % reinsurance of the stocks of the compulsory oil reserves subject to the public procurement contract.

        — Having reinsurance coverage from a reinsurance company which has a minimum credit rating of ‘ A -’ fixed by Standard and Poor"s or AM Best.

        — In the last three years having performed an insurance services for the same or similar risks for at least three legal entities.

        — Having engaged (with an employment contract or other agreement) professional personnel qualified to assess the damages of the respective public procurement.
